These Terms of Service govern the supply of heating, ventilation, air conditioning and related professional consulting services by Rytec Hvac Group Pty Ltd (ABN 84 703 047 796) of Melbourne VIC, trading via rytechvacgroup.online. By engaging our services, requesting a quotation, or accepting work carried out by us, you agree to be bound by these terms.
1. Who We Are
Rytec Hvac Group Pty Ltd is an Australian proprietary company registered in Victoria, holding ABN 84 703 047 796. We provide professional heating, ventilation and air conditioning services including system installation, scheduled maintenance, fault diagnosis, compliance checks and related business consulting for commercial and residential clients across Melbourne and greater Victoria.
2. Scope of Services
Our engagements typically include, but are not limited to:
- Supply, installation and commissioning of heating, ventilation and air conditioning systems;
- Preventative and corrective maintenance programs;
- System inspections, performance assessments and air quality checks;
- Compliance-ready documentation and reporting for commercial premises;
- Advisory and consulting services relating to energy efficiency, system selection and upgrade planning.
The precise scope of any engagement will be set out in your written quotation, service agreement or work order. Work performed outside that documented scope may attract additional fees, which will be advised and agreed before proceeding.
3. Quotations and Estimates
All quotations issued by Rytec Hvac Group Pty Ltd are valid for 30 days from the date of issue unless otherwise stated in writing. Quotations are based on the information available at the time of preparation, including site access details and the condition of existing equipment. Where hidden conditions, unsafe installations or undocumented modifications are discovered on site, we reserve the right to revise the quotation and will notify you before any additional work is carried out.
4. Payment Terms
Unless otherwise agreed in writing, invoices are payable within 14 days of the invoice date. For larger projects, we may request a progress payment or deposit prior to commencement; the applicable amount will be stated in your quotation. Overdue amounts may, to the extent permitted by law, attract reasonable administrative and recovery costs. Goods and services supplied remain subject to GST where applicable, which will be shown separately on invoices.
5. Cancellations and Rescheduling
We understand that plans change. If you need to cancel or reschedule a booked service, please provide at least 24 hours' notice. Cancellations made with less than 24 hours' notice, or instances where our technicians arrive and cannot access the premises, may attract a reasonable call-out fee to cover travel and scheduling costs. Where we cancel or reschedule for reasons within our control, we will work with you to rebook at the earliest mutually convenient time at no additional charge.
6. Access to Premises and Site Conditions
You agree to provide our personnel and subcontractors with safe, lawful and reasonable access to the premises at the agreed times, including access to plant rooms, roof spaces, ceilings and equipment locations as required. You warrant that you are authorised to permit work at the premises. We will take reasonable care while on site; however, you must notify us of any hazards, fragile surfaces, asbestos risk or restricted areas before work commences.
7. Warranties and Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services supplied again if they fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other applicable law that cannot lawfully be excluded. To the extent permitted by law, and except for those non-excludable rights, all other conditions and warranties are excluded. Workmanship warranties, where offered, will be specified in your quotation or service agreement.
8. Limitation of Liability
To the fullest extent permitted by law, and subject always to the non-excludable guarantees under the Australian Consumer Law, our liability arising from or in connection with the services is limited, at our option, to the resupply of the services or the payment of the cost of having the services resupplied. We are not liable for indirect or consequential loss, including loss of profits, business interruption or loss of data, except where such liability cannot be excluded by law.
9. Intellectual Property
All reports, schematics, compliance documentation, airflow calculations, recommendations and other materials prepared by Rytec Hvac Group Pty Ltd remain our intellectual property. You are granted a licence to use these materials for the purposes of the engagement at your premises. You may not reproduce, distribute or reuse our documentation for other projects, sites or purposes without our prior written consent.
10. Privacy
We handle personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy. Information collected when you request quotes or services is used solely to deliver those services and communicate with you, and is never sold to third parties.
11. Safety and Compliance
All work is carried out in accordance with relevant Victorian building, electrical, refrigerant handling and occupational health and safety requirements. Our technicians follow site safety rules, wear appropriate personal protective equipment and hold the licences and registrations applicable to the work performed.
12. Governing Law
These terms and any dispute arising from them are governed by the laws of the State of Victoria and the Commonwealth of Australia. The parties agree to attempt good-faith resolution of any dispute before commencing formal proceedings, and submit to the jurisdiction of the courts of Victoria.
13. Changes to These Terms
We may update these Terms of Service from time to time to reflect changes in our services, operations or applicable law. The current version will always be published on this page with an updated date. Continued engagement of our services after publication of an updated version constitutes acceptance of the revised terms.
